Ethics instructors often use cases to help students understand ethics within a corporate context, but we need to know more about the impact a case-based pedagogy has on students’ ability to make ethical decisions. We used a pre- and post-test methodology to assess the effect of using cases to teach ethics in a finance course. We also wanted to determine whether recent corporate ethics scandals might have impacted students’ perceptions of the importance and prevalence of ethics in business, so we (...) used in-depth case studies of several of the major scandals (e.g., Enron, Tyco, Adelphia). Our results are somewhat surprising since studying ethics scandals positively impacts students’ ethical decision making and their perceptions of the ethics of businesspeople. (shrink)

The problem of theorizing privacy moves on two levels, the first consisting of an inadequate conceptual vocabulary and the second consisting of an inadequate institutional grammar. Privacy rights are supposed to protect individual subjects, and so conventional ways of understanding privacy are subject-centered, but subject-centered approaches to theorizing privacy also wrestle with deeply embedded contradictions. And privacy’s most enduring institutional failure modes flow from its insistence on placing the individual and individualized control at the center. Strategies for rescuing privacy from (...) irrelevance involve inverting both established ways of talking about privacy rights and established conventions for designing institutions to protect them. In terms of theory, turning privacy inside out entails focusing on the conditions that are needed to produce sufficiently private and privacy-valuing subjects. Institutionally, turning privacy inside out entails focusing on the design, production, and operational practices most likely to instantiate and preserve those conditions. (shrink)

Feminist scholars have long argued that the pregnant body is erased – both literally and discursively – from mainstream foetal representations. Janemaree Maher argues that the placenta, as point of distinction and connection between pregnant women and foetuses, has the radical potential to refigure understandings of pregnant embodiment and subjectivity, and offer ‘a way to begin thinking through the impasse of pregnant representation’. Drawing on Maher's notion of the ‘placental body’, this article will examine the place of the placenta in (...) the practice of non-diagnostic 4D ultrasound scanning. The analysis seeks to connect Maher's theoretical perspective, and the rich feminist literature around foetal imaging, with observational data from my study of 4D scans. I will argue that the capacity of 3- and 4D sonography to image the placenta and umbilical cord in a way that is newly intelligible to lay viewers might present an opportunity for thinking differently about the interconnections – material and social – between pregnant women and foetuses and to relocate women as the subjects of their pregnancies. In April 2020, almost six out of 10 people around the world were in lockdown due to the COVID-19 pandemic. Being locked down usually has a deleterious effect on the confined individual's mental health. In this exceptionally challenging context, finding ways to minimize negative mood about the pandemic is essential. Pandemic-related negative states (“negative mood”) and recovery experiences were investigated in a sample of 264 individuals who completed daily surveys four times per day over 7 consecutive days. MSEMs analyses revealed (...) that negative mood persisted from moment-to-moment through the day, thus showing a response lag effect. Further analyses revealed that when someone experienced pandemic-related psychological detachment, relaxation, mastery, control, pleasure, or relatedness at specific periods of the day, mood had improved at the next measured time period, suggesting a protective effect. However, the pattern displayed by singles with dependents suggests that some recovery experiences at specific periods during the day seem to have a backfiring effect and worsen subsequent mood. These findings bring new insight into the role of recovery experiences during lockdowns and suggest that many could benefit from such experiences throughout the day when self-isolating. However, for individuals with multiple risk factors such as being single with dependents, some recovery experiences, at specific periods during the day, might not bring the desired outcome and future research is needed to examine if guilt or domestic burden may explain this finding. Results contribute to our understanding of how to take care of one's mental health during the current pandemic, and concrete recommendations adapted to individual contexts are provided. (shrink)

We investigate if private family firms have a greater environmental performance focus than nonfamily firms, and if this relationship is moderated by the strength of the firms’ social embeddedness. We empirically test these issues using a representative sample of 1452 private Australian small and medium-sized enterprises. Contrary to prevailing assumptions and previous indicative findings in the public firm context, our results show that family firms have a lower environmental performance focus than nonfamily firms. However, in cases where the firm is (...) highly embedded in the social community, we find that family firms have a higher environmental performance focus. We explain our unexpected results by considering the role of financial risk in publicly held family firms. Accordingly, we posit that prior findings in the public firm context may be evidence of families expropriating wealth from nonfamily shareholders rather than altruistic pro-environmental behavior. This article pursues the hypothesis that there is a structural affinity between the case study as a genre of writing and the question of gendered subjectivity. With John Forrester’s chapter ‘Inventing Gender Identity: The Case of Agnes’ as my starting point, I ask how the case of ‘Agnes’ continues to inform our understanding of different disciplinary approaches to theorizing gender. I establish a conversation between distinct, psychoanalytically informed feminisms to move from the mid-20th century to contemporary cultural debate.

The aim of this chapter is to identify the most representative measures of subjective and objective mental workload in driving, and to understand how the subjective and objective levels of mental workload influence the performance as a function of situation complexity and driving experience, i.e. to verify whether the increase of situation complexity and the lack of experience increase the subjective and physiological levels of mental workload and lead to driving performance impairments. This chapter will be useful to carry out (...) an experimental study and to improve the driver training. In the first part, we will broach the theoretical approach with two factors of mental workload and performance, i.e. situation complexity and driving experience. Indeed, a low complex situation (e.g., highways), or conversely a high complex situation (e.g., town) can provoke an overload. Additionally, performing the driving tasks implies producing a high effort for novice drivers who have not totally automated the driving activity. In the second part, we will focus on subjective measures of mental workload. A comparison of questionnaires usually used in driving will allow identifying the most appropriate ones as a function of different criteria. Moreover, we will review the empirical studies to verify if the subjective level of mental workload is high in simple and very complex situations, especially for novice drivers compared to the experienced ones. In the third part, we will focus on physiological measures. A comparison of physiological indicators will be realized in order to identify the most correlated to mental workload. An empirical review will also take the effect of situation complexity and experience on these physiological indicators into consideration. Finally, a more nuanced comparison between subjective and physiological measures will be established from the impact on situation complexity and experience. (shrink)

There is a long history of women being underrepresented in biomedical and health research. Specific women’s health needs have been, and in some cases still are, comparatively neglected areas of study. Concerns about the health and social impacts of such bias and exclusion have resulted in inclusion policies from governments, research funders, and the scientific establishment since the 1990s. Contemporary understandings of foregrounding sex and gender issues within biomedical research range from women’s rights to inclusion, to links between human rights, (...) women’s health and sustainable development, and the increasing scientific and funding expectation for studies to consider the sex and gender implications of research design, results and impact. However, there are also exploitation issues to consider when foregrounding the inclusion of women as research participants, especially for research ethics committees and institutional review boards. A hidden risk is that exploitative research designs and practices may be missed, particularly by reviewers who may not have a nuanced understanding of gender-based harm. Utilizing contemporary case studies of ethics dumping, this paper highlights some of the concerns, and makes recommendations for IRBs/research ethics reviewers to help ensure that essential research is undertaken to the highest ethical standards. This Article examines the regulatory state through the lens of evolving political economy, arguing that a significant reconstruction is now underway. The ongoing shift from an industrial mode of development to an informational one has created existential challenges for regulatory models and constructs developed in the context of the industrial economy. Contemporary contests over the substance of regulatory mandates and the shape of regulatory institutions are most usefully understood as moves within a larger struggle to chart a new direction for (...) the regulatory state in the era of informational capitalism. A regulatory state optimized for the information economy must develop rubrics for responding to three problems that have confounded existing regulatory regimes: platform power — the power to link facially separate markets and/or to constrain participation in markets by using technical protocols; infoglut — unmanageably voluminous, mediated information flows that create information overload; and systemic threat — nascent, probabilistically-defined harm to be realized at some point in the future. Additionally, it must develop institutions capable of exercising effective oversight of informationera activities. The information-era regulatory models that have begun to emerge are procedurally informal, mediated by networks of professional and technical expertise that define relevant standards, and financialized. Such models, however, also have tended to be both opaque to external observation and highly prone to capture. New institutional forms that might ensure their legal and political accountability have been slow to develop. (shrink)

The present research aimed to provide a more holistic analysis of stressful experiences in sport by examining how stress appraisal, coping and emotion are dynamically inter-related constructs and the extent to which their dynamic relationship is associated with objective performance. Based on process-oriented methods, two studies were conducted with elite athletes in order to investigate the dynamic relationship between these constructs and performance in highly demanding sport situations (Study 1: simulated competitive fencing matches during a training session; Study 2: real-life (...) competitive fencing matches during an international competition). The results of the random coefficient regression models emphasise the dynamic nature of the relationship between stress appraisal, coping behaviour, emotion and objective performance over the course of fencing matches. They allowed identification of additional mediating effects of coping and emotion within dynamic relationships between stress appraisal and performance. These studies contribute to a deeper understanding of psychological adaptation in performance environments. The implications of the findings are discussed in relation to the design of effective coping interventions to support the learning of performance-related coping skills and the attainment of performance goals among individuals in highly demanding environments. Axel Honneth distinguishes between recognitive practices according to the social domain in which they occur and this allows him to theorise the relationship between power and recognition. 'Love-based recognition', which suggests the centrality of recognition to the relationships that nurture us in the first instance, is located in the family. Honneth argues that relationships encompassed by this category are pre-political, thereby repeating the distinction between the public and the private common to much political theory. This article explores the structure of (...) this delineation in his thinking. I argue that Honneth's analysis marginalises feminist concerns with how power functions through recognition in the private sphere. Honneth also robs himself of a rejoinder to recognition sceptics, who suggest that the desire for recognition is a condition of subordination. This paper treats a heretofore-unnoticed concept in the history of the philosophical discussion of human freedom, a kind of freedom that is not defined solely in terms of the causal power of the agent. Instead, the exercise of freedom essentially involves the non-occurrence of something. That being free involves the non-occurrence, that is, the absence, of an act may seem counterintuitive. With the exception of those specifically treated in this paper, philosophers tend to think of freedom as intimately involved with (...) volition, the judging or deciding activity of the will that votes in favor of or against a proposed action. However, there are two thinkers who endorse a view where not willing constitutes human freedom. Our analysis focuses on the views of Malebranche and Locke. Both invoke a notion dubbed here as ‘absential suspension.’ On this view, freedom is associated not with the power of volition, but rather with this kind of suspension. (shrink)

Since the mid-1970s, some artists have portrayed Jesus Christ in female form. The depiction of a female Christ crucified is a particularly controversial representation that challenges theological orthodoxies and upsets the gender symbolism ingrained upon the Christian cross. The controversy and ecclesiastical censure that such works often provoke indicates the emotive power of gender subversion. This study provides a detailed account of five images of the female-Christ form in art, considers their function as theological symbols, and assesses their contribution to (...) feminist theology. It will be suggested that the Christa offers a subversive feminist strategy of representation. And—while such representations do not remove the unanswered theological difficulties associated with divine suffering, the problem of evil and the mystery of salvation—the graphic portrayal of female suffering powerfully exposes the reality of the cross as a site of patriarchal violence. A central claim in Kantian ethics is that an agent is properly morally motivated just in case she acts from duty alone. Bernard Williams, Michael Stocker, and Justin Oakley claim that certain emotionally infused actions, such as lending a compassionate helping hand, can only be done from compassion and not from duty. I argue that these critics have overlooked a distinction between an action's manner, how an action is done, and its motive, the agent's reason for acting. Through a range (...) of examples I demonstrate how an emotion can determine an action's manner without also serving as the motive. Thus, it is possible for an agent to act compassionately from duty alone. This distinction between the manner and the motive of an action not only restores a central claim in Kantian ethics but it also allows for an expanded role of emotions in moral action. (shrink)

The neuro-enhancement Modafinil promises to dramatically increase users' waking hours without much sacrifice to clarity of thought and without serious side effects (inducing addiction). For Modafinil to be advantageous, its usage must enable access to goods that themselves improve the quality of one's life. I draw attention to a variety of conditions that must be met for an experience, activity or object to improve the quality of one's life, such as positional, relational, and saturation conditions, as well as it's being (...) good for its own sake. I discuss and describe the contexts in which widespread usage (legal or not) of Modafinil would undermine these conditions being met, and thus users would fail to significantly improve the quality of their lives and would in fact potentially make both themselves and nonusers worse off in important respects thus far overlooked by critics. In the right contexts, where free time is protected and prolonged, Modafinil does have a variety of potential benefits including, most interestingly, a distinctive form of agency possible only in free time. The potential disadvantages and advantages highlighted in this article are relevant not only to public institutions deciding whether to legalize Modafinil's use as an enhancement but also to individuals deciding whether to use it illegally, as well as to the questions of how and whether to alter key features of one's context (e.g. regulating work hours or extending social services) rather than, or in addition, to regulating the use of enhancement drugs such as Modafinil. Following a suggestion made by Aquino and Arnell (2007), we assumed that the processing of emotional words is influenced by their context of presentation. Supporting this idea, previous studies using the emotional Stroop task in its visual or auditory variant revealed different results depending on the mixed versus blocked presentation of the stimuli (Bertels, Kolinsky, Pietrons, & Morais, 2011; Richards, French, Johnson, Naparstek, & Williams, 1992). In the present study, we investigated the impact of these presentation designs on the occurrence (...) of spatial attentional biases in a modified version of the beep-probe task (Bertels, Kolinsky, & Morais, 2010). Attentional vigilance to taboo words as well as non-spatial slowing effects of these words were observed whatever the mixed or blocked design, whereas attentional vigilance to positive words was only observed in the mixed design. Together with the results from our previous study (Bertels et al., 2010), the present data support the reliability of the effects of shocking stimuli, while vigilance to positive words would only be observed in a threatening context. Antibiotic resistance has become a problem of global scale. Resistance arises through mutation or through the acquisition of resistance gene(s) from other bacteria in a process called horizontal gene transfer (HGT). While HGT is recognized as an important factor in the dissemination of resistance genes in clinical pathogens, its role in the environment has been called into question by a recent study published in Nature. The authors found little evidence of HGT in soil using a culture‐independent functional metagenomics approach, which (...) is in contrast to previous work from the same lab showing HGT between the environment and human microbiome. While surprising at face value, these results may be explained by the lack of selective pressure in the environment studied. Importantly, this work suggests the need for careful monitoring of environmental antibiotic pollution and stringent antibiotic stewardship in the fight against resistance. (shrink)

In this article, we present a colophon epigram found in the manuscript Napoli, Biblioteca Nazionale, gr. II C 33. We edit the text, provide a translation and commentary and supply it with a thorough metrical analysis. Throughout the article, we investigate whether the scribe meant this colophon to be one text or three separate texts. By doing so, we will touch upon broader issues, such as Byzantine metrics in general and the Byzantine habit of compiling texts from an antiquarian perspective.

The Mental Capacity Act 2005 has stipulated that in England and Wales the ethical implications of carrying out research with people who are unable to consent must be considered alongside the ethical implications of excluding them from research altogether. This paper describes the methods that were used to enable people with severe and profound intellectual disabilities, who lacked capacity, to participate in a study that examined their experience of receiving intimate care. The safeguards that were put in place to protect (...) the rights and well-being of participants are described, and it is argued that the approaches used in this study met the requirements set out in the Mental Capacity Act 2005. Although this paper is based on research involving people with intellectual disabilities, it has implications for research involving other groups who may also lack capacity to consent, including people with mental health problems, head injuries and dementia. I defend the claim that Avicenna explains the creation of the universe in terms of emanation modeled on Neoplatonic emanation by exploring Avicenna’s account of creation by emanation in detail. I address what appears to be an obvious problem for the application of this model to creation—namely, that creation as emanation seems to be non-voluntary and has been understood to be non-voluntary by several prominent interpreters. I explore how Avicenna contends that God emanates voluntarily and non-necessarily. Avicenna is able to (...) make this claim because of his distinction between an action done of natural necessity, done voluntarily, and done with an intention. I then address whether this means that God creates freely—without any constraint whatsoever—and I conclude that God is not free not to create because God has an immutable will and has already acted to create. While God is not under any initial compulsion to create, from the fact that the universe now exists, God cannot act otherwise than to create. (shrink)

A part of Aquinas’s argument against occasionalism is that creatures like human beings must be true causes in order to be able to grow and be perfected. Were humans not true causes, God’s promises and exhortations to humankind are for naught. Here, I explore the role of virtue in habit and the perfection of human beings in Aquinas, with the larger goal of using this discussion of virtue to address secondary causation. Virtue is relevant because a) creatures can act as (...) secondary causes because of the powers God has imbued in their nature and b) humans must be secondary causes or else they could not strive toward the good by attaining proper habits. To pursue a clearer understanding of Aquinas’s theory of secondary causes, then, it is necessary to further explore how virtue acquisition works. To that end, I will discuss the role of habit, which is the basis of virtue, the notion of virtue itself and how it is acquired by these secondary causes, the importance of the acquisition of virtues through proper habits, and the connection virtue has to secondary causes. In this article, I explore Aquinas’s account of divine creative activities as a type of efficient causation. I propose that Aquinas’s works hold a framework for understanding God as an efficient cause and creating as an act of divine efficient causation that makes explicit what Aquinas views to be implicit in Aristotle’s account of efficient causation. I explore Aristotelian efficient causation in depth, offering a detailed analysis of the components of Aristotelian efficient causation. After this exploration, it is necessary to (...) address what reasons Aquinas has for viewing creation as efficient causation. I explore Aquinas’s understanding of creation and relate it to Aristotle’s analysis of efficient causation, analyzing how, precisely, Aquinas’s conception of efficient causation—which includes change, creation, and conservation—aligns with Aristotle’s. Because Aquinas’s account is derivable directly from elements in Aristotle’s account, Aquinas’s account can be understood to be implied by Aristotle’s account. (shrink)

I explore methods for the explicit instruction of critical thinking in a topics-based philosophy course. These methods make the classroom more experiential and less didactic and involve students in the philosophical process, allowing them to learn content while using the methods of philosophy to work through, explain, or produce similar content. Experiential learning—approaching learning as a “continuous process grounded in experience” involving the acquisition of practices, the specialization in those practices, and the integration of oneself into the learning process—enhances traditional (...) philosophy classrooms, and explicitly teaching critical thinking skills involves the methods of experiential learning. After an overview of relevant aspects of experiential learning and addressing how experiential learning methods can be used for the explicit teaching of critical thinking skills, I explain four methods I use to explicitly teach critical thinking in my introductory classes. This article proposes that the French performance artist Orlan, has, by undertaking a series of surgical interventions on her face and body, radically challenged current standards of beauty. By engaging with Judeo-Christian iconography, Greek mythology and French literature in her operations/performances, she has established an oeuvre that aligns her not only with corporeality and the abject body through images of the sacrificial, but also with aberrant body forms associated with the carnival. Although seduced by the rhetoric that surrounds the body (...) in technology, she has turned to excess as a strategy against the benign and controlled nature of the screen, and the media's homogenization of body images. Her new identity, although not extreme, is a site of resistance in a society bent on eliminating forms that threaten the status quo. (shrink)

There is general agreement among ecofeminists regarding the desirability of a variety of expressions of ecofeminism, but this pluralism is under threat with the emergence of an approach that emphasizes the primacy of a philosophical ecofeminism which claims the authority to prescribe what ecofeminism should be. The recent anthology Ecological Feminism is symptomatic of this trend, with contributors who affirm the philosophical significance of ecological feminism by privileging philosophers’ voices over those of other ecofeminists, rather than by engaging in critical (...) dialogue with, and exploring connections between, different ecofeminist discourses. This colonizing strategy actively excludes many women’s voices from the creation of an environmental ethic, including those of activist, spiritual, and “Third World” ecofeminists, but fails to offer any adequate philosophical grounds for doing so. Le genre s’avère en effet essentiel pour appréhender les effets différenciés qu’ont pu avoir les événements de Mai-Juin 68 sur les trajectoires des enquêtés.
